A Babys Comfort requires all visitors to this site to agree to these terms and conditions. If you do not agree, you should not use this site. By accessing the site you indicate your acknowledgment and acceptance of these terms and conditions.

THE UNDERSIGNED, HEREIN CALLED “RENTER”, WHETHER ONE OR MORE, DOES JOINTLY AND SEVERALLY HEREBY RENT FROM THE RENTAL COMPANY, HEREIN CALLED “OWNER”, THE ABOVE DESCRIBED PERSONAL PROPERTY, HEREIN CALLED “PROPERTY”, AT THE RENTAL RATES SET FORTH on this website .

LOCATION OF PROPERTY: Renter warrants and agrees that it will keep said property in its possession at the address indicated and will not remove said personal property from said address without agreement in writing executed by the owner. If renter moves said property without securing prior agreement in writing from owner, this agreement shall be thereby breached; giving the owner the right of immediate possession and renter shall be liable for prosecution under applicable state law.

DAMAGES: Renter is fully responsible for the loss, theft or destruction of said property from all causes whatever and agrees to pay the owner the fair market value of the property in such event.  Please notify us as soon as any damage or loss is noticed. In the event of damage and/or partial destruction from any cause whatever, renter agrees to pay to the owner a reasonable cost of repair to said property. This will be charged to the credit card provided for payment of the rental. 

RENTAL RETURNS: All returns are scheduled after 9:00 a.m. on return date. If you decide to extend your rental, you must notify A Babys Comfort  at (407) 312 -7609  24 hours prior to return date. Failure to do so will result in an additional service charge of $35.00 plus all additional rent for the extended period.

RELEASE OF LIABILITY

  • In consideration of the rental agreement between myself and A Babys Comfort, I acknowledge and agree to the following terms.
  • I understand that there exist certain risks of injury from the use or misuse of such items, including the potential risk of serious injury, disability or death from the use of such items.
  • I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, AND ASSUME FULL RESPONSIBILITY FOR MY USE OF SUCH ITEMS.
  • I understand the risks associated with the use of such items and understand the safety concerns regarding the items.
  • I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, HOLD HARMLESS, AND AGREE NOT TO SUE  A Babys Comfort  , the lessor of all such items I have agreed to rent, their officers, agents and employees, WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH OR LOSS OR DAMAGE to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF THE LESSORS OR OTHERWISE, except that which is the result of gross negligence or wanton misconduct.
  • I understand that this RELEASE OF LIABILITY covers each and every item which I have agreed to rent.
  • I further agree that this RELEASE OF LIABILITY shall be governed by the laws of the State of Florida.
  • I have read and understand this RELEASE OF LIABILITY and fully understand its terms and I fully understand that I have given up substantial rights by signing it and I sign it freely and voluntarily without inducement.

Miscellaneous
These terms and conditions will be governed and interpreted pursuant to the laws of the State, inside the United States of America, notwithstanding any principles of conflict of laws. This is the entire agreement between the parties relating to the use of this site. A Babys Comfort can revise these terms and conditions at any time by updating this posting. This site may be linked to other sites, which are not maintained by A Babys Comfort and we are not responsible for the content of those sites.
